Town of Wallkill Local Law Amendments

The proposed action is a collection of Local Law amendments to the Town of Wallkill’s zoning ordinance and map which are intended to implement recommendations of the most recent Comprehensive Plan. These amendments include modifications to the town’s Conservation Subdivision regulations, the creation of Water Resource Protection Regulations, the creation of a Planned Residential Development overlay district, minor zoning map edits and miscellaneous amendments to the existing zoning code. Additionally, the amendments include Design Guidelines for Conservation Subdivisions and Water Resource Protection Guidelines which are closely associated with the local law changes. Together, these amendments and additions are intended to assist in the implementation of the Town of Wallkill 2005 Comprehensive Plan.

Broadly speaking, the proposed action does the following:

1. Clarifies and strengthens the existing Conservation Subdivision regulations in the town with step-by-step review and approval procedures and illustrated design guidelines to assist planners and developers to create improved designs;

2. Helps to protect water quality by conserving and regulating development activities immediately adjacent to waterbodies and watercourses that are not currently regulated under other programs;

3. Creates a floating Planned Residential Overlay District (PRD) which encourages creative, flexible, and compact residential housing options with supporting commercial development;

4. Makes adjustments to the zoning district boundaries to significantly reduce the number of land parcels which are divided into two or more different zoning districts;

5. Provides edits to the existing zoning code to integrate the above changes and corrects previous errors and omissions in the text.
